2. ONLINE STORE
We operate an online store selling fitness, gym, exercise and related products.
We reserve the right to update the products offered through the store.
Nothing in these Terms permits us to remove or restrict mandatory consumer rights.
3. ELIGIBILITY
You must have legal capacity to enter into a purchase contract.
If you are under 18, purchases should be made with the involvement or permission of a parent or legal guardian where required.
4. ACCURACY OF INFORMATION
We make reasonable efforts to ensure that information on our website is accurate and up to date.
There may occasionally be typographical, technical or administrative errors.
Where an error relates to an existing consumer contract, it will be dealt with in accordance with applicable law.
5. PRODUCT INFORMATION
We aim to describe and display products accurately.
Product photographs are illustrative of the product offered.
Minor differences in colour may arise from screen settings, lighting, photography or reasonable manufacturing variations.
Packaging may change from time to time.
Any variation must not result in goods failing to conform to their description or the customer's statutory rights.
6. FITNESS AND EXERCISE DISCLAIMER
Physical exercise involves inherent risks.
Customers are responsible for:
• using products for their intended purpose;
• reading and following instructions and warnings;
• inspecting products before use;
• using appropriate technique;
• using suitable safety precautions; and
• stopping use if a product appears damaged or unsafe.
Where appropriate, users should obtain advice from a suitably qualified medical or fitness professional before beginning a new exercise programme, particularly where they have concerns about whether an activity is appropriate for them.
Rep Culture does not promise or guarantee specific fitness, muscle-growth, strength, weight-loss, health or athletic-performance outcomes.
Nothing in this section excludes or limits liability where doing so would be prohibited by law, including liability relating to defective or unsafe products.
7. PRICES
Prices are displayed in euro unless otherwise stated.
The total amount payable, including applicable taxes and delivery costs, will be displayed before the customer completes the purchase.
We may change prices for future purchases at any time.
Price changes do not retrospectively alter a concluded contract.
8. VAT
Where Rep Culture is not registered for VAT, we will not represent ourselves as being VAT registered and will not display a VAT registration number.
If our VAT status changes, applicable website and invoicing information will be updated.
9. ORDERS
Placing an order constitutes an offer to purchase the selected products.
Receipt of an automated order acknowledgement does not necessarily mean that we have accepted the order.
Subject to applicable law and the information displayed during checkout, acceptance generally occurs when we confirm fulfilment or dispatch of the order.
If payment has been taken for an order that we cannot accept, any amount due back to you will be refunded.
10. REASONS AN ORDER MAY NOT BE ACCEPTED
Where legally permitted, we may refuse or cancel an order for legitimate reasons including:
• a product being unavailable;
• inability to authorise payment;
• suspected fraud or unauthorised payment activity;
• incorrect delivery information;
• legal restrictions preventing the sale;
• an obvious and genuine pricing error;
• an obvious technical listing error; or
• circumstances that make fulfilment impossible.
Any cancellation will be handled in accordance with applicable Irish law.
11. OBVIOUS PRICING ERRORS
While we take reasonable care with pricing, mistakes can occur.
Where a price is clearly and obviously incorrect and the circumstances permit us legally to do so, we may contact you and offer you the opportunity to purchase at the correct price or cancel the affected order.
Any payment that must be refunded will be returned.
This clause will not be used to remove rights that have already legally arisen.
12. PAYMENT
You must provide current, complete and accurate payment information.
You confirm that you are authorised to use the selected payment method.
Payments may be processed by third-party payment providers.
We may reasonably delay fulfilment while legitimate payment or fraud checks are completed.
13. DELIVERY
Available delivery methods, estimated delivery periods and charges are displayed during checkout where applicable.
Unless another delivery period has been agreed, goods will be delivered without undue delay and in accordance with applicable Irish consumer law.
Delivery estimates are estimates unless expressly described as guaranteed.
14. THIRD-PARTY FULFILMENT AND CARRIERS
We may use third-party warehouses, fulfilment companies, suppliers, postal operators and couriers to help fulfil orders.
Using a third-party provider does not remove any responsibility that Irish law places on Rep Culture as the trader.
15. DELIVERY ADDRESS
Customers must provide a complete and accurate delivery address.
Where applicable, please provide the correct Eircode.
If you notice an address error, contact us immediately at:
[YOUR EMAIL]
We cannot guarantee an address can be changed once fulfilment or dispatch has begun.
Where additional costs are caused solely by incorrect information supplied by the customer, we may seek to recover reasonable additional costs where permitted by law.
16. TITLE AND RISK
Ownership and risk in goods will pass in accordance with applicable Irish law.
Where we arrange delivery to a consumer using a carrier selected by us, our responsibilities are not automatically ended merely because the parcel has been handed to that carrier.
17. RETURNS
Returns, refunds and cancellations are governed by our Return and Refund Policy and mandatory consumer law.
Our Return and Refund Policy forms part of these Terms.
18. FAULTY GOODS
Goods must comply with applicable Irish consumer law.
Nothing in these Terms excludes any statutory right or remedy concerning goods that are:
• faulty;
• unsafe;
• damaged;
• not as described; or
• otherwise non-conforming.
19. PRODUCT MISUSE
To the extent permitted by law, Rep Culture is not responsible for damage or injury caused solely by:
• deliberate misuse;
• use contrary to clear instructions or warnings;
• unauthorised modification;
• use outside the product's intended purpose; or
• continued use after the user becomes aware that the product has been damaged.
This does not exclude liability for a defective product or any liability that cannot legally be excluded.
20. INTELLECTUAL PROPERTY
Unless otherwise stated, intellectual property created by or owned by Rep Culture, including original branding, logos, graphics, photographs, product copy, text and website content, may be protected by applicable intellectual property law.
You may not reproduce, republish, distribute, sell or commercially exploit protected Rep Culture material without permission except where legally permitted.
Third-party trademarks remain the property of their respective owners.
21. REVIEWS AND USER CONTENT
Where customers are permitted to submit reviews, photographs or other content, they must not knowingly submit:
• fake reviews;
• unlawful content;
• infringing material;
• threatening or abusive material;
• defamatory material;
• malicious software; or
• content they do not have permission to use.
We may moderate or remove content where there is a legitimate reason to do so.
We will not knowingly represent fabricated reviews as genuine customer reviews.
22. DISCOUNT CODES AND PROMOTIONS
Discount codes and promotions may be subject to additional terms stated with the offer.
Unless otherwise stated:
• codes cannot be exchanged for cash;
• codes may have expiry dates;
• codes may apply only to selected products; and
• multiple codes may not be combined.
We may cancel fraudulent or abusive use of promotional offers where legally permitted.
23. WEBSITE USE
You must not:
• attempt to gain unauthorised access to the website;
• introduce viruses or malicious software;
• interfere with website security;
• use the website for fraud;
• impersonate another person;
• scrape or extract content unlawfully; or
• use the website in violation of applicable law.
We may reasonably restrict access to protect our customers, systems and legal rights.
24. THIRD-PARTY LINKS
Our website may contain links to websites operated by third parties.
We do not control independent third-party websites and are not responsible for their content or practices.
25. LIABILITY
Nothing in these Terms excludes or restricts any liability or consumer right that cannot lawfully be excluded or restricted.
Subject to that rule, Rep Culture will not be responsible for losses caused solely by circumstances for which Rep Culture is not legally responsible.
Rep Culture does not exclude liability for defective products, negligence, fraud or any other liability where exclusion would be prohibited by law.
26. INDIRECT OR UNFORESEEABLE LOSS
To the extent permitted by law, we are not responsible for loss that was not reasonably foreseeable as a result of our breach.
If you purchase as a consumer, nothing in this section limits mandatory consumer protection.
27. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delay or failure caused by circumstances genuinely outside our reasonable control where the law permits this.
Such circumstances may include severe weather, natural disasters, major transport disruption, strikes, governmental restrictions, war, civil disturbance or widespread infrastructure failure.
If such circumstances affect an order, we will take reasonable steps to minimise the impact and comply with applicable consumer rights.
28. FRAUD
We reserve the right to investigate orders where fraud or unauthorised payment activity is reasonably suspected.
Orders may be held or cancelled where legally justified.
We may cooperate with payment providers and competent authorities where appropriate.
29. ACCOUNT SECURITY
If customer accounts are available, customers are responsible for taking reasonable steps to protect their login credentials.
Please notify us if you believe your account has been accessed without permission.
30. COMPLAINTS
If you have a complaint, contact:
[YOUR EMAIL]
Please provide your order number and enough information for us to investigate your complaint.
We will make reasonable efforts to resolve complaints promptly.
31. CHANGES TO THESE TERMS
We may update these Terms from time to time.
Changes apply prospectively.
Changes will not retrospectively remove contractual or statutory rights relating to purchases already made.
32. SEVERABILITY
If a court or competent authority finds part of these Terms invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
33. NO WAIVER
If we do not immediately enforce a provision of these Terms, this does not automatically mean that we permanently waive our right to enforce it later.
34. GOVERNING LAW
These Terms are governed by the laws of Ireland.
If you are a consumer residing elsewhere in the European Union, nothing in this clause removes mandatory consumer protections that apply to you under applicable law.
